TERMS OF SERVICE
We advise you to carefully read the terms of service below before using the site. By using the website, you express your agreement with the stated conditions. If you do not agree with the terms, please do not use the website ninainvalentin.si.
The website ninainvalentin.si (hereinafter referred to as the Website) is a website and online store of the company Memento vivere d.o.o., Celovška cesta 106, 1000 LJUBLJANA, tax number SI30575958, registration number 3715426 (hereinafter referred to as the Provider).
The Provider reserves the right to change the terms on the Website. All changes are binding for visitors and customers (hereinafter referred to as Users) on the Website, so we recommend that you always view the current terms of service, at least before ordering and/or purchasing (hereinafter referred to as Purchasing) via the Website.
The Provider undertakes that the Website operates in accordance with the Consumer Protection Act, the Personal Data Protection Act, the Code of Obligations, the Electronic Commerce and Electronic Signature Act, the Copyright and Related Rights Act, and based on the recommendations of Chamber of Commerce and international codes for e-commerce.
The content published on the Website is the property of the Provider and may only be used for non-commercial purposes. It must not be copied, reproduced, or distributed in any other way without the permission of the Provider. The Provider is not responsible for occasional website malfunctions, possible inaccuracies of information, nor for any damage caused by the use of inaccurate or incomplete information.
CONTACT
Contact information is available on the Website in the Contact tab. All communication exchanged between the Provider and the User in electronic form is considered to have been carried out in written form and has the validity of a contract.
PURCHASE
A purchase can be made through the Website.
A purchase means the conclusion of a sales contract (hereinafter referred to as the Contract). The contract is stored in electronic form on the Provider’s server for purchases via the Website.
The contract between the Provider and the User on the Website is concluded at the moment when the Provider confirms the order (the User receives an email with confirmation of the Purchase). From this moment on, all prices and other conditions are fixed and apply to both the Provider and the User.
After confirmation of the Purchase, cancellation is only possible by email 1 hour after placing an order. In this case, the Provider will return any amount already paid, reduced by the costs of the transfer and other appropriately valued and charged related costs that it had, to the User within 3 days after the User provides him with all the necessary information.
LOGIN
It is not necessary to log in to the Website. For the Purchase, however, each User registers via the Website and, after entering the data at the selected email address, obtains a username and password with which he identifies himself during Purchases. The password is secret and known only to the user. The user is obliged to ensure that only he or a person authorized to act in his name acts in his name and with his password.
The Provider collects, manages, processes and stores the obtained data exclusively for the needs of its own business, sending informative material, offers, invoices and other necessary communication and does not offer them in any form to other legal or natural persons, unless the data is requested by a competent state authority with a final decision issued in the performance of its legal tasks.
Any notices about monthly promotions and advertising emails are clearly and unambiguously marked as advertising messages. The provider is clearly visible. The Provider will unconditionally respect the User’s wish not to receive advertising messages and notices about monthly promotions.
DELIVERY
Delivery conditions are stated in the Delivery tab. Other conditions that would deviate from the above are agreed separately by the User and the Provider. For purchases via the Website, a fixed delivery price of EUR 9,90 (Monday – Saturday), EUR 19,90 (Sunday, Bank Holiday) including value added tax is charged for delivery.
The User must provide accurate information about the recipient of the product, service or goods (hereinafter the Product), even when the User and the recipient may not be the same, and the availability of the recipient at the agreed time at the agreed location. In the event that the Product cannot be delivered to the recipient, or to a person who would be authorized to take over the Product instead of the recipient, the User is notified of this via the contact path that was used to submit the Purchase. The user must pick up the Product at the Provider’s headquarters within 24 hours of notification.
PRICES AND PAYMENT
Prices are in euros and include value added tax. Prices on the Website are presented in the description of each Product and are valid at the time of Purchase, do not have a predetermined validity and do not include the delivery price. Prices and method of payment for other methods of Purchase are agreed separately.
On the Website, the User can safely pay for the Product with one of the payment cards that the Website accepts: Activa, Mastercard, Maestro, Visa and Visa Electron. The payer (User) must be a natural person or a legal entity that owns the card. After the Purchase is completed, it is not possible to change the Product, the final amount, the delivery address and other agreed conditions. Payment is a condition for the execution of the Purchase.
When purchasing by phone and email, payments can be made in person at the Provider’s premises with cash or a payment card, payment to the Provider’s business account, or payment on delivery with cash, when the User is also the recipient and the Provider confirms such a Purchase. Except in the latter case, payment received is a condition for the execution of the Purchase.
When purchasing via the Website, the Provider issues an invoice on an electronic medium in a form suitable for printing. For all other forms of Purchase, the invoice is issued on a durable medium (paper). At the special request of the User, an invoice is also issued on a durable medium for purchases via the Website.
PRODUCTS AND SERVICES – DEVIATIONS, WARRANTY
The Provider makes its best efforts to ensure the consistency and up-to-dateness of the data and photos of the Products published on the Website. These photos should be taken as symbolic and do not guarantee the properties of the Product. The actual Product may differ from the photo on the Website, especially due to seasonal differences and the availability of individual types and colors of flowers at the time of Purchase. The Provider does not guarantee full identity of the Product with the photo, but undertakes to get as close as possible to the desired Product from the offer when carrying out the Purchase, and that the selected flowers or colors of flowers are appropriate for the event and purpose of the Purchase.
Information about a possible warranty is also stated on the Product presentation page. If there is no warranty information, the Product or part of the product does not have a warranty due to its specificity, or the information is not known at this time. In the latter case, the User can inquire with the Provider for specific information.
In the event that the User assesses that the delivered Product differs significantly from the ordered Product (informative photo of the Product), he can personally return the delivered Product to the Provider’s address within 24 hours of delivery, who, in the event that the delivered Product really differs significantly from the ordered one, replaces the product with a new one or returns the money.
COMPLAINTS
The Provider will make every effort to fulfill its obligation to establish an effective complaint handling system. Users can send complaints by email, regular mail or fax. The Provider will confirm within five working days that it has received the complaint, inform the User how long it will take to process it and keep him informed about the progress of the procedure and strive to the best of its ability to resolve any disputes amicably.
SECURITY
The Provider uses appropriate technological and organizational means to protect the transmission and storage of the User’s personal data and Purchase data. For these purposes, the Provider uses a 128-bit SSL certificate issued by an organization authorized to do so.
The User is also responsible for security himself, by ensuring the security of his username and password and for adequate software and anti-virus protection of his computer.
Child protection
The Provider does not accept Purchases on the Website from someone it knows or suspects is a child without the express permission of his parents or guardians. The Provider does not offer content or Products on the Website that are harmful to children.
Any communication intended for children will be appropriate to their age and will not exploit children’s trust, lack of experience or sense of loyalty.
Warnings
The sale of alcoholic beverages to minors is prohibited. The buyer must be of legal age. Otherwise, the provider immediately withdraws from the contract.
The Minister of Health warns: Excessive alcohol consumption is harmful to health!
